GENERAL INTRODUCTION

The Vietnam Copyright Protection Center for Music (VCPMC) is a non-profit organization, established on April 19, 2002, according to Official Letter No. 28/BTCCBCP dated April 18, 2002, of the Government Personnel Organization Committee (now the Ministry of Interior) and Decision No. 19/2002/QD dated April 19, 2002, of the Vietnam Musicians Association.

VCPMC is an official member of CISAC — the International Confederation of Societies of Authors and Composers, comprising 239 associations 123 ries and territories with nearly 5 million authors.

VCPMCS OPERATIONS

In practice, it is almost impossible for individual authors to comprehensively manage and enforce the copyrights of their musical works. Likewise, music users often face significant challenges in identifying, contacting, and obtaining permission every copyright owner, particularly when works are used across multiple ries.

To address these challenges, the Collective Management Organization (CMO) model was established. As a non-profit organization, a CMO serves as a bridge between creators and users, facilitating copyright licensing and royalty collection while ensuring a fair balance of interests among authors, music users, and the public.

OPERATING PRINCIPLES

    Operate based on the copyright authorization granted by VCPMC members.

    Copyright licensing and royalty collection are carried out through copyright licensing agreements.

  • 3

    Ensure that licensing is based on mutual agreement, voluntary participation, and a fair balance of interests, facilitating lawful use of musical works while minimizing legal risks for users.

    Establish royalty tariff schedules as the basis for negotiating the use of musical works.

  • 5

    Collect and distribute royalties in accordance with the principles of transparency and acability.

REPORTING OBLIGATIONS

Pursuant to Point (g), Clause 3, Article 56 of the Law on Intellectual Property and Article 54 of Decree No. 17/2023/ND-CP, VCPMC submits annual and ad hoc reports on its operations to its governing body, the Vietnam Musicians Association, the Ministry of Culture, Sports and Tourism, the Copyright Office of Vietnam, VCPMC members, and other competent state authorities upon request.

AUDIT POLICY

Since its establishment in 2002, VCPMCs financial activities have been audited annually by independent auditing firms. Audit reports are provided to CISAC, international collective management organizations that maintain bilateral agreements with VCPMC, and competent government authorities upon request.

TRANSPARENT COLLECTION AND DISTRIBUTION OF ROYALTIES

Royalty Collection: The amount payable and payment method are clearly specified in the licensing agreement, with official receipts and VAT invoices issued for every transaction.Royalty Distribution: Payments to authors are supported by payment vouchers and detailed usage reports submitted by music users. Authors acknowledge receipt of payments, ensuring full transparency. Royalties are distributed to both domestic and international right holders four times a year (quarterly).

VCPMC is a non-profit collective management organization established under Decision No. 19/2002/QĐ-NS dated 19 April 2002 by the Vietnam Musicians Association. Since 2007, VCPMC has been an official member of CISAC (the International Confederation of Societies of Authors and Composers), connecting more than 5 million creators through 224 member societies across 116 ries and territories.
