According to the provisions of Article 20 of the Law on Intellectual Property of 2005 amended and supplemented in 2009, organizations and individuals exploiting and using the copyrights property rights must apply for permission and pay royalties and remunerations. and other material rights to copyright holders.

Your production of MIDI karaoke discs as above has exploited and used the copy rights in the copyright of the author, so you must apply for permission and pay for use in accordance with the law.

2. Registration documents

To proceed with the process of applying for and paying for the use of music at VCPMC, you need to fill in all the information according to the registration application posted in the Licensing section of this website, including:

- Provide information about Vietnamese or international users of works, forms of use, and fields of use

- Application for permission and payment of music copyrights Form 1.3 - Application form for permission to use TPAN in publishing

- List of works registered for use according to the form

- Contract for using music works Form 2.3 - Contract for using TPAN in the field of disc publishing

3. Submit the application in person or send it by post to the address mentioned in section 1.a.

Processing time for a license request the date of receipt of a complete application, calculated in working days, excluding statutory holidays, including Saturdays, Sundays and New Year holidays:

- License to use Vietnamese musical works: up to 7 days

- License to use international musical works: up to 14 days

You can only use the work to publish MD Karaoke files legally after you have completed the contractual payment procedures and received the certificate.

According to the provisions of law: Organizations or individuals, when exploiting and using musical works in a business environment, must pay royalties to the author/right holder. The CDs have been stamped with copyright, proving that the people who produced those CDs have fulfilled their copyright obligations for their products, not pirated discs. You buy those copyrighted discs for your own home use, there is no business element, there is no other royalty to pay. But your own home is also a restaurant business, or you use it at a restaurant with a business, you still have to pay music royalties. That is the law, not only in our ry but also in the world.

According to the provisions of Article 35 of Decree 100/2006/ND-CP, the use of phonograms and video recordings that have been published in business and commercial activities must require permission and payment for the use of sound works. music.

The release of CDs is similar to the publishing of other music publications, subject to obtaining permission and paying for use in accordance with the law.

To comply with the law, you need to do the following tasks:

1. Contact to apply for permission and pay royalties:

Contact the Vietnam Music Copyright Protection Center for instructions on the necessary procedures. For the author, the owner of the work has not entrusted VCPMC, the user must directly contact the author, the owner of that work.

2. Ask for permission to use it through a written contract

- To carry out the copyright procedure at VCPMC, you need to fill in all the information according to the registration application posted in the Licensing procedure section of the website http://vcpmc.org, including:

+ Contract form No. 2.3 Contract form for using TPAN in the field of disc publishing.

+ Provide a list of works including the content of the name of the work, the music author and the lyricist according to the form.

- You can only legally use the work to publish music discs after completing the payment procedures according to the contract and getting a certificate.

3. Submit application in person or send by post to the address:

According to the provisions of law, organizations and individuals must obtain permission and pay royalties, remunerations and other material benefits to the right holder when using one, some or all of the rights belonging to the right holder. Authors, including:
- The right to publish the work or to permit others to publish the work;
- The right to make derivative works;
- The right to perform the work in public;
- The right to copy the work;
- The right to distribute or import the original or a copy of the work;
- The right to communicate the work to the public by wireline, radio, electronic information network or any other technical means.
Thus, the publications that your company will produce and distribute will use one or all of the above rights.
To fulfill your copyright obligations, you as a user can directly contact the author, the right holder to obtain permission and pay royalties. However, in practice, going to each author of each work used to obtain permission and pay royalties consumes a lot of time, effort and cost, and is even impossible, especially with international musical works.
The appropriate solution is: the user of a musical work must obtain permission and pay the music copyright royalties through a focal point of collective rights management - the only one in Vietnam at present is VCPMC. The procedure for applying for a license to use & pay royalties will be done quickly, conveniently and accurately.
The use of the work and the payment of royalties is done through a license contract to use musical works signed between VCPMC and organizations or individuals using music. The royalty collection rate is determined based on current legal documents after referring to the worldwide rate and setting in actual conditions in Vietnam.
After organizations and individuals using musical works pay royalties, VCPMC will be responsible for distributing royalties to each author and right holder.
Vietnamese law also has provisions on sanctions for individuals and organizations that commit acts of infringing upon copyright. Depending on the seriousness of the violation, the sanctioning forms may include: warning, fine, confiscation of infringing goods, suspension of operation, etc. Serious infringements will be prosecuted for penal liability. .

Pursuant to the Authorization Agreement between VCPMC and the authors, the author may not assign, transfer or permit the publication, dissemination, use of the authorized work, or directly receive payment for the use of the work. works to/ any other party unless such agreement is made before the author entrusts the right to VCPMC to provide for the reservation of rights.
However, in the event that the author agrees to give the singer the exclusive right to use the work for the production of phonograms, video recordings or performances, VCPMC may represent the author to carry out the work and come to an agreement. on the above matter with the singer about the exclusive term as well as the reasonable cost for the use of the said rights.

The Decree amending and supplementing a number of articles of Decree 79/2012/ND-CP, referred to as Decree 79, has changed a number of contents compared to Decree 79/2012/ND-CP old Decree 79 in Vietnam. Articles: 1, 7, 7a, 9,14, 17, 20, 21, 22, 24, 26 and 27.
If you are interested in applying for a license to perform, organize a performance, produce tapes, phonograms, etc. in the field of music, after reading the old Decree 79, please pay attention to the corrections. Changes of the newly issued Decree 79, pay attention to Article 9 and Article 26.
Article 9, in the new document stipulates as follows:
Competence and procedures for granting permits to organize art performances and fashion shows
1. Competence and procedures for granting permits to organize art performances and fashion shows in Vietnam:
a Authority:
- The Department of Performing Arts receives dossiers, appraises contents and forms of programs and plays, and issues and revokes permits to organize art performances and fashion shows for the subjects specified at Points a. , b, d and dd, Clause 1, Article 8 in cases where the Ministry of Culture, Sports and Tourism allows inviting foreign organizations and individuals to enter Vietnam for art performances or fashion shows;
- Department of Culture, Sports and Tourism or Department of Culture,
Sports shall receive dossiers, appraise contents and forms of programs and plays, and grant and revoke permits to organize art performances and fashion shows for the subjects specified at Points a, c and d. and dd Clause 1 Article 8 of this Decree belongs to the locality.
b Procedure:
The subjects specified in Clause 1, Article 8 of this Decree, who apply for a license to organize art performances or fashion shows, shall send 01 set of dossiers in person or by post to the Department of Performing Arts or the Department of Culture. , Sports and Tourism. Profile include:
- 01 application for a license to organize art performances and fashion shows, Form No. 01;
- 01 copy of program content, author, director, performer; Collection catalogs and design sketches for fashion shows;
- 01 piece of music or script for the work proposed for the first performance; First, for a piece of music or a script using a foreign language, there must be a Vietnamese translation and a translation companys certification;
- 01 written commitment to fully enforce the provisions of the law on copyright or a copy of the contract or written agreement with the author or copyright owner;
- 01 certified true copy of the decision allowing foreign organizations, individuals, and individuals who are Vietnamese residing abroad to enter Vietnam for art performances or fashion shows, for programs with the participation of foreign organizations and individuals, individuals being Vietnamese residing abroad;
- 01 copy of establishment decision or Certificate of business registration. The subjects who perform administrative procedures for the first time and those who have committed violations specified in Article 6 of this Decree during the course of operation shall submit certified copies or bring the originals for comparison.
2. Competence and procedures for granting permits to subjects specified in Clause 1, Article 8 of this Decree inviting foreign organizations and individuals and individuals being overseas Vietnamese to enter Vietnam to perform art , fashion show:
a Authority:
- The Ministry of Culture, Sports and Tourism issues permits to subjects specified at Points a, d and dd, Article 8 of this Decree belonging to central agencies, and invites foreign organizations and individuals to enter Vietnam to perform art performances. b Procedures:
The subjects specified in Clause 1, Article 8 of this Decree invite foreign organizations and individuals, and Vietnamese individuals residing abroad to enter Vietnam for art performances or fashion shows to send 01 set of dossiers. directly or by post to the Department of Performing Arts or the Department of Culture, Sports and Tourism or the Department of Culture and Sports.
