The promotion of international cooperation activities will increasingly affirm Vietnams position in international forums related to copyright enforcement.
Challenges of copyright protection in the context of integration
Vietnam has been integrating deeply into the international economy, reflected in the fact that we have signed many bilateral and multilateral treaties. This brings Vietnam many opportunities but also poses many challenges, requiring us to constantly improve institutions, policies and laws, including the field of intellectual property.

Although the Law on Intellectual Property has been promulgated for more than 10 years, prior to that, issues of copyright protection were also recorded in the Civil Code and a number of ordinances and decrees, but it can be said that the Copyright infringement is still quite common today. This situation is due to many objective and subjective reasons, including the fact that people do not really have a sense of respect for copyright. In particular, the use of foreign works without fulfilling the obligation to pay royalties may cause Vietnam to lose credibility in the enforcement of copyright protection conventions that we have signed.
Recently, some organizations that collectively manage copyright CMOs such as SACEM France, PRS UK, GEMA Germany... have contacted us to ask for information about foreign programs/songs that have been licensed for use. to perform or not. Specifically, the program "Moonsoon festival" took place on March 26, 2019, in Ho Chi Minh City; "BoneyM Joy concert" took place at the National Convention Center, Hanoi, on August 3, 2019; "Make Life Flavorful - Independence Palace" took place on 5/5/2019, at Thong Nhat Hall, 135 Nam Ky Khoi Nghia, Ben Thanh Ward, District 1, HCMC…
According to information the Vietnam Music Copyright Protection Center VCPMC, most of the programs that CMOs are interested in and inquire about have not yet applied for permission and paid for the use of copyrights. Although VCPMC has contacted and sent a text to the organizer to request payment and remedy after verification, all efforts and efforts have been fruitless. The organizers as well as the places where the performances are held have shown a lack of interest and responsibility to deal with these backlogs and shortcomings. Even the organizer did not have any feedback or pushed the responsibility to another unit, not to mention many cases where the organizer could not be found and contacted.
As a result, most of the performances asked by some foreign organizations have not received any information or results. Similar to domestic authors, authors of foreign musical works also suffer loss of interests, copyright of works/copyright is infringed and not properly protected. This may affect your rys impression and assessment of a music market in Vietnam that is not serious, professional, and not active in copyright enforcement, as well as affecting commitments between the two ries. Vietnam with the international, treaties that Vietnam has signed.
Continue to improve the regulations
In accordance with the international conventions that Vietnam has acceded to and signed, as well as in line with the actual situation when science and technology develop, the protection of copyright and the law on the protection of human rights is required. Authors must change in response to new challenges.
In 2019, the Copyright Office participated in many international events on world intellectual property in the Asia-Pacific region such as Japan, Korea... Some other ries wanted to develop the system when they wanted to develop the system. A system of collective representative organizations have come to Vietnam to learn the Vietnam Center for Music Copyright Protection, which is a very encouraging sign in international copyright cooperation activities.
In the first months of 2020, in the context of the Covid-19 epidemic having many negative impacts on all aspects of society, the Copyright Office has implemented and completed many important activities such as: formulating plans, reporting. report to the International Economic Integration Board of the Ministry of Culture, Sports and Tourism on the content of negotiating copyright and related rights in the Free Trade Agreement between Vietnam and the European Free Trade Area EFTA; implementing commitments on copyright and related rights in the Comprehensive and Progressive Agreement for Trans-Pacific Partnership CPTPP... Many cooperation programs with ries and international organizations on the issue Protection of copyright and related rights has also been implemented...
Through the implementation of the Project on Raising awareness and awareness of compliance with the law on copyright and related rights for the period 2017-2020, reality has proven that the disregard for copyright and arbitrarily infringing on copyright has been carried out. fake, related rights have been basically overcome; The awareness of complying with the law on copyright has had many positive changes.
One of the important points of view and objectives stated by the Project is to overcome the limitations and inadequacies in the propagation and dissemination of the law on copyright and related rights; promote communication in order to raise awareness and sense of law observance of copyright and related rights of the whole society; forming a sense of law compliance when using and exploiting works, performances, phonograms, video recordings and broadcasts.
